Passenger
Subject to six months in jail or twenty-five days of community service in a program benefitting children.
Subject to a mandatory fine with a minimum of $1000 and twenty-five days of community services in a program benefitting children
A maximum fine of $2,500.00
If bodily harm to a passenger under sixteen:
Class four felony with a minimum fine of $2,500.00 to a maximum of $25,000.00 plus twenty-five days of community service in a program benefitting children and
Mandatory: Minimum ten days in jail or 480 hours of community service
If suspended, revoked, or no license or insurance, then:
Class four felony, with one to three years of imporisonment or
Probation up to three months and
Mandatory: Minimum of 10 days in jail or 480 hours of community service.
If driving in a school bus zone with a limit of twenty miles per hour in effect and accident with bodily harm other than bodily harm, permanent disability, or disfigurement:
Class four felony with one to three years of imprisonment or
Probation up to thirty months and
Mandatory: minimum of ten days in jail or 480 hours of community service
If Prior to Reckless Homicide
Class three felony with non-probationable 2-5 years of imprisonment
If Great bodily harm, permanent disability, or disfigurement:
Class four felony with one to twelve years imprisonment or
Probation up to thirty months and
Mandatory: Minimum of ten days in jail or 480 hours of community service and
Minimum fine of $1,500.00
Second Offense
Class A Misdemeanor
No Court Supervision - Mandatory Conviction
Revoction of Driving Privileges
Mandatory of five days in jail or 240 hours of community service

If 2nd DUI and Prior Reckless Homicide, then class four felony.
If BAC is greater than .16:
Add additional two days of jail to above penalties
Mandatory: Minimum fine of $1,250.00
If Passenger:
Class two felony and three to seven years of imprisonment or probation up to fourty-eight months and
Minimum of $2,500.00 plus twenty-five days of community service in a program benefitting children and
Mandator: Minimum of ten days in jail or 480 hours of community service
If Bodily Harm to a passenger under 16:
Class two felony and three to seven years of imprisonment or probation up to 48 months and
Minimum of $5,000.00 to a maximum of $25,000.00

Mandatory: Minimum of ten days in jail or 480 hours of community service
If Great bodily harm, disability, or disfigurement to any person:
Class 4 Felony, from probation to one to twelve years of imprisonment

Class three felony non-probationable two to five years
If accident with great bodily harm:
Class four felony with one to three years of imprisonment or
Probation of up to thirty months and
Mandatory of a minimum of ten days in jail or 480 hours of community service.

Third Offense
Class two felony
Three to seven years of imprisonment or
Porbation of up to fourty-eight months and
Mandatory of a minimum of ten days in jail or 480 hours of community service.
DUI Tech Fee of $1,000.00.

If BAC is greater than .16, then:
Mandatory of 90 days in jail and
Mandatory of a minimum fine of $2,500.00

Class two felony, non-probationable
Three to seven years of imprisonment and

Sixth Offense
Class X Felony non-probationable
six to thirty years imprisonment and

DUI Death
If violation of DUI proximately causes death to another:
Class two felony
Minimum is probation, or three to fourteen years for one death.
Minimum probation to six to twenty-eight years for two or more deaths
Judge must find extraordinary circumstances to give probation
